Fault and Liability Analysis
Forensic engineering analysis of design defects, negligence, and regulatory violations to determine liability and fault ratios for insurance claims.
Forensic Engineering and the Determination of Shared Fault
Fault and liability analysis is a forensic-engineering study conducted following major damage in a building, industrial facility, work machine, or production line. Our expert team retrospectively examines the physical destruction and system data at the scene, drawing technical and legal liability boundaries as to whether the event resulted from force majeure, material fatigue, a design flaw, or user negligence.
Root-Cause and Metallurgical/Mechanical Examination Process
To locate the breaking point in the chain of liability, our laboratory and field teams follow these operational steps:
Material and Metallurgical Autopsy (Failure Analysis)
Broken, cracked, or deformed metal, composite, or reinforced-concrete parts are examined in the laboratory using scanning electron microscopes (SEM), determining conclusively whether the failure originated from micro-casting voids during manufacturing or from excessive loading.
Design and Standards Compliance Review
The system or structure's original design, CAD drawings, and static calculations are re-simulated against national and international standards (ISO, EN, ASTM) to check for an engineering flaw at the design stage.
Maintenance, Installation, and User Protocol Analysis
The system's historical maintenance logs, SCADA/automation records, and installation manuals are reviewed to chronologically list operator errors, neglected periodic maintenance, or unauthorized interventions, and to determine each party's share of fault.
Why Fault and Liability Analysis?
In multi-million-lira industrial losses or workplace accidents involving loss of life, the parties naturally tend to shift responsibility onto one another. Separating right from wrong — protecting compensation rights in insurance subrogation cases, or defending a defendant's or claimant's position in criminal courts with technical evidence — is only possible through this independent forensic report.
"In short: fault and liability analysis decodes the technical negligence behind complex accidents and structural failures, providing judicial authorities and insurance bodies with a precise, error-free map of liability."
